Today, supposedly, a grand jury convenes in Missouri to examine the facts surrounding the death of Michael Brown at the hands of FPD officer Darren Wilson, to determine if an indictable crime has been committed.  One talking head on TV even said that hearsay would be permitted there, which if true is nothing less than a travesty.

The grand jury review itself, it would seem, is coming awfully early.  The general public does not realize how long it takes to complete a homicide investigation. The toxicology screen on the deceased, which can be a critical factor, may or may not have been completed yet, but to the best of my knowledge such results have not yet been released to the public.

Members of the grand jury will be under tremendous social and political pressure to indict.  The state’s own governor has, incredibly, called for “vigorous prosecution.”   Damn shame he didn’t have the integrity to call for “vigorous investigation” instead.  One should not be convicted before trial in the Governor’s Mansion instead of in a courtroom.

The smell of mob rule is growing stronger, and more fetid.

Also today, Attorney General Eric Holder is expected to be on the ground in Ferguson for investigative purposes.  Many pundits expect him to visit with the family of the deceased; certainly, there’s nothing wrong with that.

But I sincerely hope that the AG, our nation’s chief law enforcement officer, will visit the family of the injured officer as well.

  1. As to the hearsay that may be permitted at the hearing, I suspect they are referring to the statement or testimony of Officer Wilson about the incident, should he decide to testify. No attorney hear, so I stand ready to be corrected.

By that same logic, it would make sense that Eric Holder should be recused from any participation in the case due to his obvious lack of impartiality toward the police and Officer Darren Wilson in particular.

    That said, let’s get a little technical here. Unless the suspect took those cigars from the clerk under threat, the crime is not an armed robbery, but a theft, a petite retail theft to be more technically correct. By shoving the store clerk, Brown committed a simple battery, and depending on what Brown said to the clerk, assault could be added too, although the suspect’s superior size and threatening demeanor would support that anyway. If it could be proven that the suspect entered the store with the intention of committing a crime. he should be charged with retail burglary also. If Brown and his fellow gangbanger had talked about committing a crime at the store, they could be charged with conspiracy too, but that’s stretching it a bit.

    Lots of statements are suspect in this situation. One witness stated that the police officer was in his patrol car when he grabbed Brown by the neck which supposedly started the physical altercation. Considering that Brown stood 6′ 4″ tall, it’s doubtful the cop could reach up that high while seated in his vehicle to even touch the suspect’s shoulder much less his neck.

    Maybe this officer possessed that much fabled “Long Arm of the Law”?

    The captain of the Missouri State Patrol, Ron Johnson was praised for his handling of the crowd soon after he was put in charge of the situation. It was obvious from the start he was on the side of the mob. I watched an early press conference he was in, where after he was introduced, Johnson immediately walked away from the podium and microphone to be among the crowd. This was obviously done to pander to the mob as no one could now hear him without the microphone amplifying his voice, and he had to return to the podium for the rest of the event. Besides, allowing the mob to loot and vandalize businesses during the night without any police intervention is not the way to properly handle potentially explosive situations as it emboldens the bad guys to do even more violent things.

    Maybe the governor should call up Arizona sheriff Joe Apaio and put him in charge to clean up this huge mess. This can only happen in a pot induced dream though.

    Officer Wilson suffered a severe injury by a person who just committed a felony being a strong arm robbery, the mind set of Michael Brown I am sure was that he was not going to jail for that robbery in regardless of what the officer was aware of, obviously a violent struggle ensued which resulted in a blown out eye socket and probably stunning Officer Wilson who was in fill uniform next to his marked patrol car, his assailant Michael Brown was much larger and stronger than he was making this an uneven battle, the officer was alone and has split seconds to react to what is happening. Officer Wilson decided to escalate to use of deadly force to prevent further severe bodily harm and stop the threat. The first rounds were ineffective and did not stop him the head shot did as stated by Dr. Button from second autopsy. Those rounds were more likely fired in rapid succession which take Nano seconds.

    Now take into account Officer Wilson patrolled the streets of Ferguson a town with an estimated 80 percent African American population for six years prior to this deadly force encounter without incident, that is powerful. Also there has never been an Officer in the City of Ferguson who has ever killed anyone according to news sources.

    Lastly the obvious favoritism shown to one side and disgusting politics that has been involved in the interference of tipping the scales of justice in this particular case is deeply troubling…..

Several state legislatures have attempted to diminish the use of hearsay in state grand jury proceedings.
